WELCOME TO SUNSARA YOGA
By continuing to access the Sunsara Yoga studio, off-site facilities or website you are agreeing to comply with, and be bound by, the following terms and conditions of use, which together with the privacy policy, govern Sunsara Yoga’s relationship with you. The term ‘you’ refers to the user or viewer of our website/studio/off-site facilities. We reserve the right to update, change or replace any part of these terms and conditions at any time. It is your responsibility to periodically check our website for changes. If you disagree with any part of these terms and conditions, please do not use this website, or Sunsara Yoga services.

COPYRIGHT & INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, Sunsara Yoga owns all copyright of the material used in classes and on the website. All registered or unregistered trademarks used on the website are the property of their respective owners. All copyright, data, text, software, images, graphics, trademarks, logos, interfaces, photographs, videos, design, blog articles and other intellectual property (Content) on the website is owned, controlled by, or licensed to Sunsara Yoga. Except for viewing the content for your own personal non-commercial use, Sunsara Yoga does not grant you any rights to use the website or content for any other purpose unless it expressly consents in writing.
STUDIO AND CLASS TERMS AND CONDITIONS
Please read through the terms and conditions thoroughly before enrolling. When enrolling as a student of Sunsara Yoga, of 51 Whitehaven Way, Pelican Waters, Qld 4551, you agree to the terms and conditions as laid out on the Yoga Sunsara website www.sunsarayoga.com.au.

While we endeavour to deliver all our classes on time and as advertised, classes are subject to change or cancellation without notice. Sunsara Yoga is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason, but will do its best to accommodate the needs of customers.

Please arrive at least 5-10 minutes before class. Late entry is discouraged and entry cannot be guaranteed. At the start of class, the door may be locked for security purposes.

Bookings – whatever payment plan you are on – are to be made via our website, or in the studio in advance of the class. Payment must be made before starting class.

You agree that you have been examined by a qualified medical practitioner within the past six months and have been found by such practitioner to be physically able to perform all yoga exercises.

You declare that you are over 18 years of age. Sunsara Yoga classes do not accommodate children.

You declare that you are not currently pregnant and/or have given birth in the last 6 months.

You declare that you have not undergone any surgery in the past 12 months.

Classes at Sunsara Yoga may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death.

You will follow all instructions given to you by Sunsara Yoga teachers and you acknowledge that any failure to do so will be at your own risk and may cause injury.

Teachers are subject to change without notice.

Leaving class early without a medical reason is strongly discouraged.

Sunsara Yoga is not responsible for the safekeeping of your belongings.

Sunsara Yoga has the right to refuse entry/participation at any time.

Sunsara Yoga is in no way liable for any injury, loss of property or death resulting from attending our studio or offsite facilities.

By booking into a class, you automatically agree to the above terms & conditions.
CANCELLATION POLICY
-
Our cancellation policy is in place to ensure everyone has a chance to attend. We understand that things come up.

Class cancellations must be made direct to the teacher via phone call or text message. Cancellations via email, chat apps (such as Messenger or Whatsapp) or social media are not accepted.

Cancelling more than four working hours (8am-5pm) before the class start time will not incur a forfeit of the class fee. E.g. cancelling after 5pm the night before a 7am class will incur the forfeit.

Students who fail to attend, or cancel less than 4 hours before a class, or outside of working hours, will incur a forfeit of the class fee. Wavering the forfeiture is at Sunsara Yoga's discretion.

Students who have booked a class and opted to pay in cash at the studio, and who cancel more than four working hours, or fail to attend, will be billed for the class fee and sent bank details for direct transfer. Sunsara Yoga reserves the right to refuse to take future bookings from students who do not pay for these missed classes.

We understand that people become sick. For those who have pre-paid a 5-class or 12-class pass and are unable to attend a class or classes due to sickness, we will strive to accommodate make-up classes where possible.
PRICING

All prices are correct at the time of online publication. Prices are subject to change without notice.

We reserve the right to amend prices and printing errors.

Prices may increase from time to time to reflect increases in cost.

All purchases are final. Sunsara Yoga does not offer refunds, suspensions or extensions on individual class purchases or five-week and 12-week class passes for change of mind, injury, illness, change of address, or any other reason.

All class purchases and five-week and 12-week passes are for the individual user/purchaser and are non-transferable. Five-week and 12-week class passes cannot be shared.

A student has 5 weeks from the date of purchase to use a 5-class pass (unless they are a founding member, when a different 5-class pass offer was available)

A student has 12 weeks from the date of purchase to use a 12-class pass (unless they are a founding member, when a different 12-class pass offer was available)

Sunsara Yoga reserves the right to pass on the cost of any additional bank fees which may incur from disputed or failed transactions regarding a students’ account.
SPECIAL OFFERS

A special or introductory offer may be made available from time-to-time.

A half-price special for new members refers to one, half-price casual class for the first booking.

Sunsara Yoga's introductory offer is only available to new students.
-
Students who have previously practised at Sunsara Yoga previously are not eligible for an introductory offer.

A Bring A Friend Bonus offer enables any participant to receive one half-price casual class if they introduce a friend who is new to Sunsara Yoga. The friend will also receive one half-price casual class.
GIFT CARDS

​Gift cards are redeemable for its value on services only; cards cannot be redeemed for cash.

Once a class booking has been made using a gift card, our cancellation policy takes effect.

Cancellations with less than four working hours (8am-5pm) notice and no-shows are considered redeemed.

Transference to another person is only possible in certain conditions and at the discretion of Sunsara Yoga.

Five-class pass gift cards, and 12-class pass gift cards must used within 8 weeks and 12 weeks respectively from the first class booking.

Gift cards expire one year, from the date of purchase.

​Users must advise at the point of booking that a gift card is being used.

Gift cards must be presented to Sunsara Yoga prior to class, to correlate with our records

Lost or stolen gift cards are not replaceable or refundable. Treat your gift card like cash and keep it secure.

INDEMNITY

By accessing our website, you agree to indemnify and hold harmless Sunsara Yoga, its directors, employees, agents, and affiliates from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the wesite, even if we have been advised of the possibility of such damages.

We make no representations or warranties regarding the accuracy, reliability, or completeness of the content on this website. All content is provided “as is.”

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law or other applicable laws that cannot be excluded.
PRIVACY

We undertake to take all due care with any information which you may provide to us when accessing our website and within the studio. Whilst personal records are kept securely, we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk.

JURISDICTION AND GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland for any disputes arising out of or relating to your use of the Site.

CHANGES TO THESE TERMS

We reserve the right to amend these Terms at any time without notice. Changes will take effect when they are posted on the Site. Your continued use of the Site signifies your acceptance of any updated Terms.
